General Terms and Conditions for Event Booking

The following General Terms and Conditions apply to the contract concluded with the respective TUI BLUE Sarigerme Park, P.K 1 Ortaca Postanesi, 48600, Ortaca Mugla / Türkei (hereinafter referred to as the “Hotel” or “Organizer”) for participation in a Event organized by the hotel (“Event Contract”).

Please read these terms carefully, as they govern the legal relationship between you and the hotel.

If you did not book the Event directly with and through the hotel, please also observe the terms and conditions of the respective point of sale, which govern the legal relationship between you and the sales agent acting as an intermediary. For the terms applicable to the legal relationship between you and [Insert Legal entity here] as the intermediary of this Event (hereinafter “TUI BLUE”), please refer in particular to the TUI BLUE Agency Terms and Conditions for Events and, available on the TUI BLUE website under “General Terms and Conditions”. §1 Registration and Binding Booking

1.1. When you register for a TUI BLUE Event (by completing the online booking form), you submit a binding offer to the hotel to conclude a contract for participation in the advertised TUI BLUE Event. The contract comes into effect when you receive the booking confirmation by email or when it is handed to you in printed form at the hotel. A binding booking confirmation via email will be issued by the hotel or by our intermediary TUI BLUE, who is authorized to do so. 1.2 If the content of the booking confirmation differs from the original registration, this constitutes a new offer, to which the hotel is bound for six days. The contract is concluded on the basis of this new offer if the customer accepts it within this period through explicit declaration or payment. Special requests, customer-specific terms, or verbal agreements require written confirmation by the hotel. Travel agencies and online agents act solely as intermediaries and have no authorization to make binding promises unless confirmed in writing by the hotel.

§2 Eligibility for Registration and Participation

2.1 Participation is subject to specific conditions, including minimum age, health requirements, and other prerequisites determined by the hotel. The minimum age for registration is 18 years; the minimum age for participation varies by event and is stated in the event description. Participation is for private purposes only. 2.2 You may only participate if you are a guest at the hotel at the time of the event. The hotel may withdraw from the contract if no room booking can be assigned to your event registration within 7 days. 2.3 For sport-related events, you must be physically fit and familiar with the sport. By registering, you

confirm that no medical issues prevent participation. Any allergies, medical conditions, or prior illnesses must be communicated in writing before the event.

§3 Payment

3.1 The event price is determined by the published event description and becomes due upon conclusion of the contract. 3.2 Payment is made upon arrival at the hotel and charged to your room account. 3.3 VAT corresponds to the applicable rate in the country where the event takes place.

§4 Scope of Service

4.1 The contract includes participation in the advertised TUI BLUE Event and the services listed in the event description. The hotel endeavors to conduct the event with the advertised trainer, expert, or sports ambassador (“Pro”). However, the hotel cannot guarantee availability and may provide an equivalent substitute. You have no claim to specific training content or a specific Pro.

4.2 Additional agreements modifying services require explicit confirmation. Brochures or online content are non-binding unless they constitute the official event description.

4.3 Accommodation, transport, and meals are not included.

§5 Event Material

5.1 You are responsible for all equipment provided during the event and must replace it in case of damage or loss. 5.2 You are liable for damages caused to other participants, staff, or the Pro, unless caused solely by another party.

§6 Withdrawal by the Customer

6.1 You may withdraw at any time before the event begins. The withdrawal must be submitted in writing. 6.2 The hotel may charge a cancellation fee unless the withdrawal is due to extraordinary circumstances (Force Majeure).

6.3 Cancellation fees: Up to 30 days before the event: full refund 29 to 15 days before: 50% fee 14 days or fewer / no-show: 100% fee

6.4 Cancelling your event booking does not affect other services (hotel, flights). These must be cancelled separately with the respective provider.

§7 Withdrawal by the Hotel

The Hotel may withdraw from the contract if: 7.1 You violate these terms, particularly §2. 7.2 The event must be cancelled due to Force Majeure. 7.3 The minimum number of participants is not reached (as stated in the event description). 7.4 Notification of cancellation will be made as soon as possible, but at least 4 weeks before the event in case of insufficient participation. 7.5 The rules of §6.4 apply also to hotel withdrawals.

§8 Exclusion from the Event

The hotel may exclude you without notice if: You disrupt the event despite warnings You behave in breach of contract You ignore instructions from staff or the Pro You appear intoxicated at the event In these cases, the full event fee remains payable.

§9 Unused Services and Rebooking

9.1 If you fail to use any part of the event for reasons attributable to you (e.g., late arrival), the hotel retains the event fee. 9.2 Rebooking is not possible. Events are one-time only.

§10 Duty to Cooperate

10.1 If you believe the event is not provided as agreed, you must notify the event manager immediately. 10.2 Failure to do so may exclude price reduction claims.

§11 Rights and Duties of the Event Management

11.1 The event management is authorized to handle complaints and attempt remediation, but cannot acknowledge claims against the hotel.

11.2 They may exclude you from the event as per §8.

§12 Liability

12.1 You participate at your own risk. Equipment must be checked prior to use. The hotel is liable only in cases of negligence or intent. Accident insurance is recommended. 12.2 For non-bodily damages, liability is limited to intent, gross negligence, or breach of essential duties. Liability is capped at three times the event price. 12.3 You indemnify the hotel against third-party claims.

§13 Force Majeure

The hotel may cancel, postpone, or modify the event due to natural disasters, political unrest, terrorism, or other unforeseen events.

§14 Data Protection

If access to personal data occurs during the provision of contractual services, the relevant provisions of the General Data Protection Regulation (EU GDPR) and the German Federal Data Protection Act (BDSG), as well as other applicable data protection regulations, will be observed. In particular, personal data will be collected, processed, and/or used exclusively for the purpose of fulfilling the contract. Technical and organizational measures will be implemented to ensure the integrity, availability, and confidentiality of the data and to prevent unauthorized access by third parties. §15 Written Form

15.1 Any amendment to the contract requires written form. 15.2 Even unilateral declarations (e.g., withdrawal) must be in writing.

§16 Invalidity of Individual Provisions

If individual clauses are invalid, the remainder of the contract remains valid.

§17 Applicable Law and Jurisdiction

These terms are governed by German law. Jurisdiction for claims against the hotel is Hannover. Claims by the hotel must be filed at the customer’s place of residence, except in cases involving merchants or persons residing abroad.
